Giới thiệu chung về Thông tư số 01/2000/TT-TCBD

Thông tư số 01/2000/TT-TCBD được ban hành ngày 20 tháng 3 năm 2000 bởi Tổng cục Bưu điện nhằm hướng dẫn thực hiện Quyết định số 242/1999/QĐ-TTg ngày 30 tháng 12 năm 1999 của Thủ tướng Chính phủ về điều hành xuất nhập khẩu hàng hóa năm 2000. Phạm vi điều chỉnh và đối tượng áp dụng

Thông tư quy định phạm vi áp dụng đối với các hoạt động thương mại và phi thương mại liên quan đến thiết bị chuyên ngành bưu điện. Các đối tượng chịu sự điều chỉnh bao gồm:

  • Các doanh nghiệp có giấy phép kinh doanh xuất nhập khẩu thiết bị bưu chính, viễn thông.
  • Các tổ chức, cơ quan ngoại giao, tổ chức quốc tế hoặc cá nhân nhập khẩu thiết bị để phục vụ nhu cầu sử dụng riêng, nghiên cứu khoa học, thử nghiệm công nghệ hoặc triển lãm thương mại.
  • Các hoạt động tạm nhập tái xuất, tạm xuất tái nhập hoặc chuyển khẩu các thiết bị thuộc danh mục quản lý chuyên ngành của Tổng cục Bưu điện.

Danh mục thiết bị chuyên ngành bưu điện quản lý bằng giấy phép

Thông tư phân định rõ danh mục các trang thiết bị bắt buộc phải có giấy phép nhập khẩu của Tổng cục Bưu điện trước khi làm thủ tục thông quan tại cửa khẩu hải quan, bao gồm:

  • Thiết bị phát sóng và thu-phát sóng vô tuyến điện: Các loại máy phát hình, phát thanh, thiết bị truyền dẫn viễn thông qua vệ tinh, thiết bị vi ba, hệ thống thông tin di động và các thiết bị thu-phát sóng vô tuyến khác nhằm bảo đảm an toàn tần số vô tuyến điện quốc gia và tránh gây can nhiễu có hại.
  • Thiết bị tổng đài và truyền dẫn viễn thông: Các hệ thống tổng đài điện thoại công cộng, tổng đài nội bộ dung lượng lớn, thiết bị truyền dẫn quang học và các thiết bị kết nối mạng cốt lõi.
  • Thiết bị đầu cuối chuyên dùng: Các loại máy điện thoại, máy fax, thiết bị kết nối Internet và các thiết bị đầu cuối khác cần được kiểm soát để bảo vệ an toàn an ninh thông tin và tính đồng bộ của mạng lưới viễn thông quốc gia.

Điều kiện và thủ tục cấp giấy phép nhập khẩu

Để được cấp giấy phép nhập khẩu thiết bị chuyên ngành bưu chính, viễn thông, các tổ chức và doanh nghiệp phải tuân thủ các điều kiện và quy trình nghiêm ngặt:

  • Hồ sơ đề nghị cấp phép: Doanh nghiệp phải nộp đầy đủ hồ sơ lên Tổng cục Bưu điện, bao gồm đơn đề nghị cấp giấy phép nhập khẩu (theo mẫu quy định), bản sao hợp đồng thương mại hoặc chứng từ có giá trị tương đương, tài liệu kỹ thuật chi tiết thể hiện rõ tính năng, tần số, công suất của thiết bị, và bản sao giấy phép thiết lập mạng viễn thông hoặc giấy phép sử dụng tần số vô tuyến điện (nếu có).
  • Yêu cầu về tiêu chuẩn kỹ thuật: Thiết bị nhập khẩu phải hoàn toàn phù hợp với quy hoạch phát triển bưu chính, viễn thông quốc gia, đồng thời đáp ứng các tiêu chuẩn ngành, tiêu chuẩn quốc gia hoặc tiêu chuẩn quốc tế được cơ quan quản lý Việt Nam thừa nhận.
  • Thời hạn giải quyết hồ sơ: Trong thời hạn quy định kể từ ngày nhận đủ hồ sơ hợp lệ, Tổng cục Bưu điện có trách nhiệm thẩm định và cấp giấy phép nhập khẩu cho doanh nghiệp. Trong trường hợp từ chối cấp phép, cơ quan quản lý phải trả lời bằng văn bản và nêu rõ lý do cụ thể.

Quy định về chứng nhận hợp chuẩn và kiểm tra chất lượng

Công tác quản lý chất lượng thiết bị nhập khẩu được quy định chặt chẽ nhằm bảo vệ quyền lợi người tiêu dùng và an toàn hệ thống:

  • Các thiết bị thuộc danh mục bắt buộc phải thực hiện thủ tục chứng nhận hợp chuẩn và dán tem hợp chuẩn trước khi đưa vào lưu thông trên thị trường hoặc kết nối vào mạng viễn thông công cộng.
  • Việc kiểm tra, thử nghiệm chất lượng thiết bị phải được thực hiện bởi các phòng thử nghiệm, trung tâm kiểm định được Tổng cục Bưu điện chỉ định hoặc thừa nhận kết quả lẫn nhau theo các điều ước quốc tế mà Việt Nam tham gia.

Tổ chức thực hiện và điều khoản thi hành

Thông tư số 01/2000/TT-TCBD giao trách nhiệm cho các cơ quan trực thuộc Tổng cục Bưu điện phối hợp chặt chẽ với Tổng cục Hải quan và các cơ quan chức năng liên quan để kiểm tra, giám sát việc thực hiện nhập khẩu thiết bị theo đúng giấy phép được cấp. Mọi hành vi tự ý thay đổi thông số kỹ thuật, nhập khẩu sai chủng loại hoặc giả mạo giấy tờ trong hồ sơ xuất nhập khẩu sẽ bị xử lý nghiêm khắc theo quy định của pháp luật hiện hành.

CIRCULAR

GUIDING THE PRIME MINISTER’S DECISION No. 242/1999/QD-TTg OF DECEMBER 30, 1999 ON IMPORT-EXPORT MANAGEMENT IN 2000

In furtherance of the Prime Minister’s Decision No. 242/1999/QD-TTg of December 30, 1999 on import-export management in 2000; After consulting and reaching agreement with the Ministry of Trade in Official Dispatch No. 1131/TM-XNK of March 20, 2000, the General Department of Post and Telecommunications hereby guides the implementation of Article 9 on import and export of goods on the list of items subject to post and telecommunications specialized management as follows:

I. GENERAL PROVISIONS ON THE MANAGEMENT OF IMPORT-EXPORT POST AND TELECOMMUNICATIONS GOODS, EQUIPMENT AND SUPPLIES

1. Post and telecommunications goods, equipment and supplies on the list subject to post and telecommunications specialized management include those used exclusively on the public and special-use post and telecommunications networks.

2. Import goods, equipment and supplies on the list subject to post and telecommunications specialized management stipulated in this Circular must fully satisfy the conditions, technical standards and usage properties already defined and promulgated by the General Department of Post and Telecommunications.

3. The General Department of Post and Telecommunications shall neither grant permits nor ratify import/export goods items, quantities and value.

4. Import goods, equipment and supplies on the list subject to post and telecommunications specialized management must be those in service of post and telecommunications operations and services, which are permitted to be used, exploited and supplied in Vietnam.

- The compatibility with Vietnamese technologies, post and telecommunications networks as well as the technical norms and standards promulgated or permitted for application by the State and/or the General Department of Post and Telecommunications;

In addition to the above-listed goods, units and enterprises that have registered their business with suitable business lines and import/export enterprise codes may import goods according to their demands.

The export of goods items on the list subject to post and telecommunications specialized management at the foreign partners’ requests as agreed upon under conditions in the import contracts shall not have to satisfy all conditions, technical standards and usage properties defined and promulgated by the General Department of Post and Telecommunications.

III. IMPORT-EXPORT CONDITIONS

III.1. Post and telecommunications goods, equipment and supplies

- Before an importation, a standard compatibility certificate issued by the General Department of Post and Telecommunications according to the standards mentioned in Section II.1 is required. The procedures for standard compatibility certificate issuance shall comply with the General Department of Post and Telecommunications’ regulations.

- For import goods being radio transmitters, receiver-transmitters, radar, radio support equipment and radio remote control equipment, their frequencies or frequency channels must be approved by the General Department of Post and Telecommunications in strict compliance with the frequency planning under the Prime Minister’s Decision No.85/1998/QD-TTg of April 16, 1998 ratifying the plan on radio frequency allocation for professional operations in Vietnam and they must have technical properties compatible with the ITU standards as well as the General Department of Post and Telecommunications’ approval reflected in the standard compatibility certificate.

- For the import of post and telecommunications goods, equipment and/or supplies into Vietnam for display and/or demonstration, accompanying foreign delegations on visits to Vietnam at the official invitations of Vietnamese agencies or organizations, the standard compatibility certificate is not required, but there must be approval of the General Department of Post and Telecommunications or the competent State bodies.

1. Postage stamps used for postal service business, philatelic stamps being the live ones (without cancellation seal):

- Only units and enterprises licensed to trade in postal services may import and/or export such stamps

- Before the importation or exportation, a written consent of the General Department of Post and Telecommunications is required.

2. For philatelic stamps (with cancellation seal), except for the live ones stipulated at Point 1 of this Section, the licensed business units and enterprises may import them according to their demands.

3. Postage stamps and stamp articles banned from import and export:

- Postage stamp articles which have been suspended from issuance or withdrawn by order of the General Department of Post and Telecommunications

- Postage stamp articles banned from circulation by the General Department of Post and Telecommunications

- Postage stamp articles with unhealthy contents that incite or cause hostility between nationalities, contrarily to the Vietnamese customs and laws.

- Postage stamp articles already warned of by the Universal Postal Union (UPU), the International Philatelic Federation (FIP) or the Asian Philatelic Federation (FIAP) and banned from participation in international stamp exhibitions.

IV. IMPLEMENTATION PROVISION

This Circular takes effect as from April 1st, 2000; in the course of implementation, if any problems arise, the relevant State management agencies as well as the post and telecommunications goods importers/exporters should promptly report them to the General Department of Post and Telecommunications for consideration and settlement.
