Tóm tắt Thông tư số 11/2002/TT-TM-XNK hướng dẫn quản lý xuất nhập khẩu kim cương thô
Thông tư số 11/2002/TT-TM-XNK do Bộ Thương mại (nay là Bộ Công Thương) ban hành nhằm thiết lập cơ chế quản lý hoạt động xuất khẩu, nhập khẩu kim cương thô của Việt Nam. Đây là văn bản pháp lý quan trọng nhằm thực hiện Quy chế chứng nhận Quy trình Kimberley (Kimberley Process Certification Scheme - KPCS), góp phần ngăn chặn việc thương mại kim cương xung đột trên thị trường quốc tế và bảo vệ uy tín thương mại của Việt Nam.
Phạm vi áp dụng (Điều 1)
Thông tư quy định phạm vi áp dụng đối với các hoạt động xuất khẩu, nhập khẩu kim cương thô thuộc các mã phân loại hải quan (HS) cụ thể sau:
- Kim cương thô chưa phân loại hoặc mới chỉ được cưa, tách hoặc phân chia sơ bộ (Mã HS 7102.10).
- Kim cương công nghiệp thô hoặc mới chỉ được cưa, tách hoặc phân chia sơ bộ (Mã HS 7102.21).
- Kim cương phi công nghiệp thô hoặc mới chỉ được cưa, tách hoặc phân chia sơ bộ (Mã HS 7102.31).
Đối tượng áp dụng (Điều 2)
Các quy định tại Thông tư này áp dụng bắt buộc đối với các đối tượng tham gia vào chuỗi cung ứng kim cương thô, bao gồm:
- Các thương nhân, tổ chức và cá nhân Việt Nam thuộc mọi thành phần kinh tế có hoạt động xuất khẩu, nhập khẩu, gia công, chế tác hoặc kinh doanh kim cương thô.
- Các tổ chức, cá nhân nước ngoài thực hiện các hoạt động liên quan đến thương mại kim cương thô trên lãnh thổ Việt Nam.
Nguyên tắc quản lý và điều kiện xuất nhập khẩu (Điều 3)
Hoạt động xuất nhập khẩu kim cương thô phải tuân thủ nghiêm ngặt các nguyên tắc quốc tế nhằm kiểm soát nguồn gốc xuất xứ và ngăn chặn kim cương máu:
- Giới hạn đối tác giao thương: Việt Nam chỉ cho phép xuất khẩu kim cương thô sang hoặc nhập khẩu kim cương thô từ các quốc gia và vùng lãnh thổ là thành viên chính thức của Quy trình Kimberley.
- Yêu cầu về Chứng nhận Quy trình Kimberley (KPC): Mọi lô hàng kim cương thô khi nhập khẩu vào Việt Nam hoặc xuất khẩu ra nước ngoài đều phải kèm theo Giấy chứng nhận Quy trình Kimberley bản gốc, hợp lệ do cơ quan có thẩm quyền của nước xuất khẩu cấp.
- Quy cách đóng gói bảo mật: Kim cương thô phải được đóng gói trong các container hoặc hộp chuyên dụng, được niêm phong chống giả mạo và bảo đảm không bị can thiệp, tráo đổi trong suốt quá trình vận chuyển quốc tế.
Cơ quan quản lý và thủ tục kiểm tra (Điều 4)
Quy định về thẩm quyền, trách nhiệm của các cơ quan nhà nước trong việc giám sát hoạt động xuất nhập khẩu kim cương thô:
- Bộ Thương mại (nay là Bộ Công Thương): Là cơ quan đầu mối chịu trách nhiệm cấp Giấy chứng nhận Quy trình Kimberley cho kim cương thô xuất khẩu từ Việt Nam, đồng thời tiến hành kiểm tra, xác nhận tính hợp lệ của chứng nhận đối với các lô hàng kim cương thô nhập khẩu.
- Cơ quan Hải quan: Thực hiện thủ tục thông quan cho các lô hàng kim cương thô dựa trên Giấy chứng nhận Quy trình Kimberley hợp lệ và kết quả kiểm tra thực tế tình trạng niêm phong của lô hàng. Cơ quan Hải quan có quyền từ chối thông quan và xử lý theo quy định nếu phát hiện sai lệch về niêm phong hoặc chứng nhận đi kèm.
- Cơ chế phối hợp liên ngành: Các cơ quan chức năng có trách nhiệm phối hợp chặt chẽ trong việc kiểm tra, giám sát, thống kê số liệu và báo cáo định kỳ về tình hình xuất nhập khẩu kim cương thô nhằm đảm bảo tính minh bạch và tuân thủ đầy đủ các cam kết quốc tế của Việt Nam.

CIRCULAR
GUIDING THE MANAGEMENT OF ROUGH DIAMOND IMPORT AND EXPORT
In furtherance of the Prime Minister's Directive No.1600/2002/CT-QHQT-VPCP dated December 13, 2002 on Vietnam's participation in the Kimberley Process Certification Scheme applicable to rough diamond import and export activities;
The Ministry of Trade hereby guides the management of rough diamond import and export as follows:
I. GENERAL PROVISIONS
1. Definition of rough diamonds: Rough diamonds mean diamonds of all types, which have not yet been processed or have been simply whittled, abraded or chiseled, or partly polished classified according to HS 71 02 10 00, 71 02 21 00 and 71 02 31 00 codes.
2. To strictly prohibit the import of conflict diamonds, which mean assorted rough diamonds used by rebellious or terrorist movements to finance their activities, including plots to weaken or overthrow legal governments, or diamonds acquired through the use or threat to use forcible measures or military means.
3. Enterprises may import and/or export rough diamonds only from and/or to the countries participating in the Kimberley Process Certification Scheme according to Appendix No. 01 to this Circular.

1. Vietnamese enterprises, when carrying out procedures for exporting rough diamonds, must produce to the customs offices the Kimberley process certificates granted by the Ministry of Trade according to the set form. For lots of rough diamonds exported in the period when such form has not yet been issued, the Ministry of Trade shall grant the Government Letter of Comfort to enterprises in order to certify such goods lots.
2. Vietnamese enterprises, when carrying out procedures for importing rough diamonds, must produce to the customs offices the Kimberley process certificates granted by the exporting countries. In case of non-availability of such certificates, the enterprises must produce the Government Letters of Comfort of the exporting countries, which clearly state that the lots of rough diamonds have been exported in accordance with the provisions of the Kimberley Process Certification Scheme.
3. After carrying out the customs clearance procedures for lots of rough diamonds imported into Vietnam, the customs offices shall make and send the Import Confirmation for such goods lots according to the form prescribed in Appendix No. 02 to this Circular (not printed herein) to the Ministry of Trade of the Socialist Republic of Vietnam for further transfer to the Secretariat based in the country being the president thereof.
III. IMPLEMENTATION PROVISIONS
1. The Ministry of Trade shall have to receive dossiers and grant Kimberley process certificates or the Government Letters of Comfort to enterprises.
2. This Circular takes implementation effect as from January 1, 2003. All the provisions contrary to those in this Circular are hereby annulled.
