CIRCULAR

PRESCRIBING AND GUIDING THE GOVERNMENT’S DECREE NO. 35/2014/ND-CP OF APRIL 29, 2014, AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE GOVERNMENT’S DECREE NO. 29/2011/ND-CP OF APRIL 18, 2011, PROVIDING STRATEGIC ENVIRONMENTAL ASSESSMENT, ENVIRONMENTAL IMPACT ASSESSMENT AND ENVIRONMENTAL PROTECTION COMMITMENT (*)

Pursuant to the November 29, 2005 Law on Environmental Protection;

Pursuant to the Government’s Decree No.21/2013/ND-CP of March 4, 2013, defining functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to the Government’s Decree No. 29/2011/ND-CP of April 18, 2011, providing strategic environmental assessment, environmental impact assessment and environmental protection commitment;

Pursuant to the Government’s Decree No. 35/2014/ND-CPofApril29, 2014, amending and supplementing a number of articles of the Government’s Decree No. 29/2011/ND-CP of April 18, 2011, providing strategic environmental assessment, environmental impact assessment and environment protection commitment;

At the proposal of the general director of the Vietnam Environment Administration and the director of the Legal Department;

The Minister of Natural Resources and Environment promulgates the Circular prescribing and guiding the Government’s Decree No. 35/2014/ND-CP of April 29, 2014, amending and supplementing a number of articles of the Government's Decree No. 29/2011/ND-CP of April 18, 2011, providing strategic environmental assessment, environmental impact assessment and environment protection commitment.

1. This Circular prescribes and guides the Government’s Decree No. 35/2014/ND-CP of April 29, 2014, amending and supplementing a number of articles of the Government’s

Decree No. 29/2011/ND-CP of April 18,2011, providing strategic environmental assessment, environmental impact assessment and environment protection commitment.

2. This Circular applies to state agencies, and domestic and foreign organizations and individuals (below referred to as organizations and individuals) related to the formulation, appraisal and approval of detailed environmental protection plans; inspection and confirmation of implementation of detailed environmental protection plans; and formulation and registration of simple environmental protection plans.

Article 2. Formulation, appraisal and approval of detailed environmental protection plans; inspection and confirmation of implementation of detailed environmental protection plans, and formulation and registration of simple environmental protection plans

The formulation, appraisal and approval of detailed environmental protection plans; inspection and confirmation of implementation of detailed environmental protection plans; and formulation and registration of simple environmental protection plans shall comply with the Minister of Natural Resources and Environment’s Circular No. 01/2012/TT-BTNMT of March 16, 2012, on the formulation, appraisal and approval of detailed environmental protection plans and inspection and confirmation of their implementation; and formulation and registration of simple environmental protection plans.

Article 3. Effect

1. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees at all levels, and related organizations and individuals shall implement this Circular.

2. This Circular takes effect on June 20, 2014.

3. Any problems arising in the course of implementation of this Circular should be reported in writing to the Ministry of Natural Resources and Environment for consideration and settlement.-
