Giới thiệu về Quyết định số 1130/2005/QĐ-NHNN
Quyết định số 1130/2005/QĐ-NHNN được ban hành ngày 01 tháng 8 năm 2005 bởi Thống đốc Ngân hàng Nhà nước Việt Nam. Mục tiêu và phạm vi điều chỉnh của văn bản
Quyết định này tập trung vào việc điều chỉnh các quy định liên quan đến cơ chế dự trữ bắt buộc của các tổ chức tín dụng hoạt động tại Việt Nam. Việc sửa đổi, bổ sung này hướng tới các mục tiêu cốt lõi sau:
- Tối ưu hóa công cụ dự trữ bắt buộc để thực thi chính sách tiền tệ của Ngân hàng Nhà nước một cách linh hoạt, hiệu quả và phù hợp với tình hình phát triển kinh tế.
- Đảm bảo an toàn hệ thống các tổ chức tín dụng, kiểm soát quy mô tín dụng và khả năng thanh khoản của toàn hệ thống ngân hàng.
- Tạo điều kiện thuận lợi cho các tổ chức tín dụng trong việc quản lý nguồn vốn và thực hiện nghiêm túc nghĩa vụ dự trữ bắt buộc theo quy định của pháp luật.
Tầm quan trọng của văn bản trong hệ thống pháp luật ngân hàng
Quyết định số 1130/2005/QĐ-NHNN đóng vai trò là công cụ điều tiết gián tiếp quan trọng của Ngân hàng Nhà nước. Bằng việc hoàn thiện và sửa đổi các điều khoản trong Quy chế dự trữ bắt buộc cũ, văn bản đã giúp củng cố khung pháp lý về hoạt động ngân hàng, đáp ứng kịp thời yêu cầu phát triển và hội nhập của hệ thống tài chính tiền tệ Việt Nam trong giai đoạn mới.

DECISION
ON THE AMENDMENT, SUPPLEMENT OF SEVERAL ARTICLES OF THE REGULATION ON REQUIRED RESERVE APPLICABLE TO CREDIT INSTITUTIONS ISSUED IN CONJUNCTION WITH THE DECISION NO. 581/2003/QD-NHNN DATED 9 JUNE 2003 OF THE GOVERNOR OF THE STATE BANK
THE GOVERNOR OF THE STATE BANK
- Pursuant to the Law on the State Bank of Vietnam in 1997; the Law on the amendment, supplement of several Articles of the Law on the State Bank of Vietnam in 2003;
- Pursuant to the Law on the Credit Institutions in 1997; the Law on the amendment, supplement of several Articles of the Law on the Credit Institutions in 2004;
- Pursuant to the Law on the issuance of legal documents in 1996; the Law on the amendment, supplement of several articles of the Law on the issuance of legal documents in 2002;
- Pursuant to the Decree No. 52/2003/ND-CP dated 19 May 2003 of the Government providing for the function, assignment, authority and organizational structure of the State Bank of Vietnam;
- Upon the proposal of the Director of the Monetary Policy Department,
DECIDES:
Article 1. To amend, supplement several articles of the Regulation on required reserve applicable to credit institutions issued in conjunction with the Decision No. 581/2003/QD-NHNN dated 9 June 2003 of the Governor of the State Bank as follows:
1. Paragraph 4, Article 19 shall be amended, supplemented as follows:
"4. Within the first 10 working days of each month, the Banking Operation Department shall be responsible to consolidate report on the required reserve performance of credit institutions under their management and of credit institutions delivered to by the State Banks branches in provinces, cities under the central Governments management for making report to the Governor of the State Bank, at the same time send to the State Bank Inspectorate, the Money Policy Department in accordance with attached Form 3.

3. Within the first 7 working days of each month, the State Banks branches in provinces, cities where credit institutions locate their Head office shall be responsible to consolidate the required reserve performance of credit institutions under their management and send to the State Bank of Vietnam (the Banking Operation Department) in accordance with attached Form 3.
3. The Form 3 attached to the Regulation shall be replaced by the Form attached to this Decision.
4. To repeal Article 21.
Article 2. This Decision shall be effective from 1 September 2005.
Article 3. The Director of the Administrative Department, Chief Inspector of the State Bank, the Director of the Banking Operation Department, the Director of the Monetary Policy Department, Head of units of the State Bank, the General Managers of the State Banks branches in provinces, cities under the central Governments management shall be responsible for the implementation of this Decree.
