Quyết định số 116/1999/QĐ-BTC ban hành ngày 21 tháng 09 năm 1999 bởi Bộ Tài chính là một văn bản pháp lý quan trọng quy định về khung phí quản lý nhà nước trong lĩnh vực hàng không dân dụng tại Việt Nam. Văn bản này thiết lập cơ sở pháp lý cho việc thu, nộp và quản lý các loại phí liên quan đến hoạt động quản lý bay, an toàn hàng không và các dịch vụ công ích khác do cơ quan nhà nước có thẩm quyền thực hiện.

Dựa trên danh mục trích xuất và cấu trúc pháp lý của văn bản, các điều khoản đầu tiên từ Điều 1 đến Điều 4 tập trung vào các quy định nền tảng sau:
- Phạm vi điều chỉnh và đối tượng áp dụng (Điều 1): Xác định rõ các loại phí quản lý nhà nước về hàng không được phép thu. Đối tượng áp dụng bao gồm các tổ chức, cá nhân trong và ngoài nước sử dụng các dịch vụ quản lý nhà nước về hàng không dân dụng tại Việt Nam, bao gồm cả các hãng hàng không nội địa và quốc tế hoạt động trong vùng trời hoặc tại các cảng hàng không Việt Nam.
- Ban hành khung mức phí (Điều 2): Quy định chi tiết về khung mức phí (biểu phí) áp dụng cho từng danh mục quản lý cụ thể. Khung phí này đóng vai trò là giới hạn trần và sàn để các cơ quan chức năng áp dụng mức thu cụ thể phù hợp với từng thời kỳ và điều kiện kinh tế - xã hội.
- Nguyên tắc thu và nộp phí (Điều 3): Xác định đồng tiền thu phí (có thể bằng Đồng Việt Nam hoặc Ngoại tệ tự do chuyển đổi đối với các hãng hàng không nước ngoài). Quy định nghĩa vụ nộp phí của các đối tượng thụ hưởng dịch vụ quản lý nhà nước và trách nhiệm của cơ quan thu phí trong việc xuất hóa đơn, chứng từ hợp lệ.
- Chế độ quản lý và sử dụng nguồn thu (Điều 4): Quy định tỷ lệ phân chia nguồn thu phí giữa ngân sách nhà nước và đơn vị trực tiếp thực hiện nhiệm vụ quản lý bay, giám sát an toàn hàng không. Phần giữ lại được dùng để trang trải chi phí tổ chức thu phí và nâng cao năng lực quản lý, phần còn lại phải nộp đầy đủ vào Ngân sách Nhà nước theo quy định của pháp luật về phí và lệ phí.
- Ý nghĩa và tác động của văn bản đối với ngành hàng không
- Tạo hành lang pháp lý minh bạch: Việc ban hành khung phí giúp các doanh nghiệp hàng không chủ động trong việc lập kế hoạch tài chính, đồng thời hạn chế sự tùy tiện trong việc áp đặt các khoản phí từ phía các cơ quan quản lý.
- Hội nhập quốc tế: Việc chuẩn hóa các khoản phí quản lý nhà nước về hàng không theo tiêu chuẩn quốc tế giúp Việt Nam thực hiện tốt các cam kết quốc tế về hàng không dân dụng, thu hút các hãng hàng không nước ngoài mở đường bay đến Việt Nam.
- Tăng cường năng lực quản lý bay: Nguồn thu từ phí quản lý nhà nước được tái đầu tư một phần vào hạ tầng kỹ thuật, trang thiết bị giám sát và đào tạo nguồn nhân lực chất lượng cao cho ngành hàng không.

DECISION
PROMULGATING THE BRACKET OF FEES FOR THE STATE MANAGEMENT OVER AVIATION
THE MINISTER OF FINANCE
Pursuant to the Government’s Decree No.15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No.178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on the charges and fees belonging to the State budget;
Pursuant to the Government’s Official Dispatch No. 3010/VPCP-KTTH of August 6, 1998 on the collection of aviation fees;
After getting opinions of the Civil Aviation Administration of Vietnam (in its Official Dispatch No. 1423/CHK-TC of August 24, 1999);
At the proposal of the General Director of Tax,
DECIDES:
Article 1.- To promulgate together with this Decision the bracket of fees for the State management over aviation.
Article 2.- The agencies collecting the fees for the State management over aviation shall carry out the registration, declaration, collection and remittance of such fees with/to the tax authorities of the localities where such fees are collected according to the provisions of the Ministry of Finance’s Circular No.54/1999/TT-BTC of May 10, 1999 guiding the implementation of the Government’s Decree No.04/1999/ND-CP of January 31, 1999 on the charges and fees belonging to the State budget.
Article 3.- The agencies collecting the fees for the State management over aviation shall be entitled to set aside 40% of the total collected fee amount to cover expenses for organizing the collection as prescribed at Point 5b, Section III of the Ministry of Finance’s Circular No.54/1999/TT-BTC of May 10, 1999 guiding the implementation of the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on the charges and fees belonging to the State budget.

Article 5.- Organizations and individuals liable to pay fees, units assigned by the Civil Aviation Administration of Vietnam to organize the fee collection, and the concerned agencies shall have to implement this Decision.

Footnotes: The fee levels specified in Section 1 (the fees for granting of certificates to aircraft) and Section 4 (the fees for granting of licenses and/or certificates to specialized aviation operating personnel), shall not include expenses for hiring foreign experts, foreign machinery and equipment for expertise inspection, and expenses for checking health of personnel. Organizations, legal persons and individuals that wish to be granted such licenses and/or certificates must pay the above-said fees (if any) by themselves.-
