Tóm tắt Quyết định số 57/2000/QĐ-BTC ban hành biểu mức thu lệ phí đăng ký hộ tịch
Quyết định số 57/2000/QĐ-BTC do Bộ Tài chính ban hành là văn bản pháp lý quan trọng quy định về mức thu, chế độ thu, nộp, quản lý và sử dụng lệ phí đăng ký hộ tịch. Dưới đây là chi tiết các nội dung cốt lõi từ Điều 1 đến Điều 4 của Quyết định này:
- Phạm vi áp dụng và đối tượng nộp lệ phí (Điều 1 và Điều 2)
- Đối tượng nộp lệ phí: Áp dụng đối với các cá nhân (bao gồm công dân Việt Nam và người nước ngoài) khi thực hiện đăng ký các sự kiện hộ tịch tại cơ quan nhà nước có thẩm quyền của Việt Nam theo quy định của pháp luật.
- Các hoạt động đăng ký hộ tịch chịu lệ phí: Bao gồm các thủ tục như khai sinh, khai tử, kết hôn, nhận cha, mẹ, con, thay đổi, cải chính hộ tịch, xác định lại dân tộc, đăng ký giám hộ và các việc hộ tịch khác theo quy định.
- Trường hợp miễn lệ phí: Quyết định quy định cụ thể các trường hợp được miễn nộp lệ phí hộ tịch nhằm bảo đảm quyền lợi cho các đối tượng chính sách, người có công, hộ nghèo hoặc các trường hợp đăng ký hộ tịch lần đầu theo quy định của pháp luật về an sinh xã hội.
- Biểu mức thu lệ phí đăng ký hộ tịch
- Mức thu trong nước: Quy định mức lệ phí áp dụng đối với công dân Việt Nam cư trú trong nước khi đăng ký hộ tịch tại Ủy ban nhân dân cấp xã hoặc cấp huyện. Mức thu được thiết kế phù hợp với điều kiện kinh tế - xã hội của từng địa phương.
- Mức thu có yếu tố nước ngoài: Áp dụng mức lệ phí riêng biệt (thường cao hơn) đối với các trường hợp đăng ký hộ tịch có yếu tố nước ngoài thực hiện tại Sở Tư pháp hoặc tại các Cơ quan đại diện ngoại giao, Cơ quan lãnh sự của Việt Nam ở nước ngoài.
- Chế độ thu, nộp, quản lý và sử dụng lệ phí (Điều 3)
- Trách nhiệm của cơ quan thu: Các cơ quan nhà nước có thẩm quyền thực hiện đăng ký hộ tịch có trách nhiệm tổ chức thu, nộp lệ phí theo đúng mức quy định, niêm yết công khai mức thu tại địa điểm thu lệ phí.
- Tỷ lệ trích để lại: Cơ quan thu lệ phí được phép trích để lại một tỷ lệ phần trăm (%) nhất định trên tổng số tiền lệ phí thu được để trang trải chi phí cho công tác đăng ký hộ tịch và thu lệ phí (như in ấn biểu mẫu, sổ sách hộ tịch, văn phòng phẩm và bồi dưỡng cho cán bộ làm công tác hộ tịch).
- Nộp ngân sách nhà nước: Toàn bộ số tiền lệ phí còn lại sau khi trừ đi tỷ lệ được để lại phải được nộp kịp thời vào ngân sách nhà nước theo chương, loại, khoản, mục tương ứng của Mục lục ngân sách nhà nước hiện hành.
- Điều khoản thi hành (Điều 4)
- Hiệu lực thi hành: Quyết định này có hiệu lực thi hành sau 15 ngày kể từ ngày ký ban hành. Các quy định trước đây về lệ phí đăng ký hộ tịch trái với Quyết định này đều bãi bỏ.
- Trách nhiệm hướng dẫn và thi hành: Các cơ quan, tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này. Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương và các cơ quan liên quan có trách nhiệm chỉ đạo, kiểm tra việc thực hiện thu lệ phí theo đúng quy định pháp luật.

DECISION
ISSUING THE CIVIL STATUS REGISTRATION FEE LEVELS
THE MINISTER OF FINANCE
Pursuant to the Government’s Decree No. 15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to the Government’s Decree No. 184/CP of November 30, 1994 stipulating the procedures for marriage, claim of out-of-wedlock children, child adoption, and sponsorship between Vietnamese citizens and foreigners;
Pursuant to the Government’s Decree No. 83/1998/ND-CP of October 10, 1998 on civil status registration;
Pursuant to the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget;
After obtaining the opinions of the Ministry of Justice (Official Dispatch No. 163/TP-HT of January 31, 2000) as well as the Ministry for Foreign Affairs (Official Dispatch No. 06-CV/NG-LS-PL of January 4, 2000) and at the proposal of the General Director of Tax,
DECIDES:
Article 1.- To issue together with this Decision the Table of civil status registration fee levels. The fee levels stipulated in the Table cover also expenses for dossiers related to the civil status management work.
Article 2.- Payers of fees prescribed in this Decision are persons for whom the competent State agencies perform civil status-related work according to the provisions of law.
Article 3.- The competent State agencies performing the function of State management over civil status and also organizing the collection of civil status fees include:

2. The Justice Services of the provinces and centrally-run cities, which shall collect fees at the levels specified in Section B of the Table of fee levels.
3. The Vietnamese overseas diplomatic missions and consulates, which shall collect fees at the levels specified in Section C of the Table of fee levels.
The commune/ward/district township People’s Committees and the Justice Services of the provinces and centrally-run cities shall collect civil status registration fees in Vietnam Dong; Vietnamese overseas diplomatic missions and consulates shall collect fees in US dollar or local currency at the exchange rate announced by the host country at the collection time.
Article 4.- The fee-collecting agencies are allowed to temporarily deduct 30% of the actually collected fee amount and remit the remainder (70%) into the State budget. The temporarily deducted amount must be incorporated into the annual budget estimates and used according to the prescribed regime. At the end of each year, any unused amount must be remitted into the State budget. The collecting agencies shall have to organize the collection, remittance and management of fees according to the provisions in the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget and the Ministry of Finance’s Circular No. 54/1999/TT-BTC of May 10, 1999 guiding the implementation thereof.
Article 5.- This Decision takes effect 15 days after its signing and replaces the provisions on civil status fees in Joint Circular No. 33/TT-LB of April 24, 1995 of the Ministry of Finance and the Ministry of Justice prescribing the collection, remittance, management and use of fees for marriage registration, recognition of marriage, claim of out-of-wedlock children, registration of child adoption and recognition of child adoption between Vietnamese citizens and foreigners and in Joint Circular No. 83/TTLB of October 4, 1993 of the Ministry of Finance and the Ministry for Foreign Affairs prescribing the collection of foreign consul charges and fees.
Article 6.- Organizations and individuals subject to payment of fees and concerned agencies shall have to implement this Decision.
