Tóm tắt Quyết định số 782-TTg ngày 24 tháng 10 năm 1996 của Thủ tướng Chính phủ về việc sắp xếp lại các tổ chức nghiên cứu và phát triển khoa học và công nghệ
Quyết định số 782-TTg là một văn bản pháp lý quan trọng trong tiến trình cải cách hành chính và đổi mới cơ chế quản lý hoạt động khoa học và công nghệ (KH&CN) tại Việt Nam. Văn bản tập trung vào việc quy hoạch, tổ chức lại hệ thống các cơ quan nghiên cứu nhằm tối ưu hóa nguồn lực quốc gia, nâng cao năng lực nghiên cứu và gắn kết chặt chẽ giữa khoa học với sản xuất, đời sống.
1. Mục tiêu và định hướng sắp xếp hệ thống tổ chức KH&CN (Điều 1)
Điều khoản này xác định rõ mục tiêu chiến lược của việc rà soát và tổ chức lại các cơ quan nghiên cứu và phát triển trên phạm vi cả nước:
- Khắc phục tình trạng phân tán, trùng lặp về chức năng, nhiệm vụ giữa các viện, trung tâm nghiên cứu thuộc các Bộ, ngành và địa phương.
- Tập trung nguồn lực đầu tư trọng điểm cho các tổ chức nghiên cứu đầu đàn, có năng lực giải quyết các nhiệm vụ khoa học công nghệ lớn của đất nước.
- Phân định rõ ranh giới hoạt động giữa các tổ chức nghiên cứu cơ bản, nghiên cứu chiến lược, chính sách (do Nhà nước cấp kinh phí) và các tổ chức nghiên cứu ứng dụng, triển khai công nghệ (hướng tới tự chủ tài chính).
2. Tiêu chuẩn, điều kiện hoạt động và thành lập mới (Điều 2)
Quy định thiết lập các tiêu chuẩn nghiêm ngặt nhằm nâng cao chất lượng hoạt động của các tổ chức KH&CN:
- Các tổ chức nghiên cứu và phát triển muốn tồn tại hoặc thành lập mới phải chứng minh được năng lực thực tế, bao gồm đội ngũ cán bộ khoa học có trình độ chuyên môn cao, cơ sở vật chất, trang thiết bị kỹ thuật đáp ứng yêu cầu nghiên cứu.
- Phải có phương hướng, nhiệm vụ nghiên cứu rõ ràng, phù hợp với chiến lược phát triển khoa học công nghệ quốc gia và nhu cầu thực tiễn của ngành, địa phương.
- Kiên quyết giải thể, sáp nhập hoặc chuyển đổi hình thức hoạt động đối với các tổ chức không đủ điều kiện, hoạt động kém hiệu quả hoặc không có đóng góp thiết thực cho sự phát triển kinh tế - xã hội.
3. Cơ chế tài chính và phương thức hoạt động mới (Điều 3)
Nội dung này đặt nền móng cho việc đổi mới cơ chế tài chính trong hoạt động khoa học công nghệ:
- Nhà nước tiếp tục ưu tiên đầu tư ngân sách cho các tổ chức thực hiện nhiệm vụ nghiên cứu cơ bản, nghiên cứu chiến lược phục vụ quản lý vĩ mô và các chương trình khoa học công nghệ trọng điểm cấp nhà nước.
- Khuyến khích và bắt buộc các tổ chức nghiên cứu ứng dụng, triển khai kỹ thuật chuyển dần sang cơ chế tự trang trải chi phí hoạt động thông qua việc ký kết hợp đồng dịch vụ khoa học, chuyển giao công nghệ và liên kết sản xuất kinh doanh với các doanh nghiệp.
- Tạo điều kiện cho các nhà khoa học chủ động khai thác các nguồn vốn ngoài ngân sách nhà nước để phục vụ nghiên cứu phát triển.
4. Tổ chức thực hiện và phân công trách nhiệm (Điều 4)
Để đảm bảo quyết định được thực thi hiệu quả, Thủ tướng Chính phủ giao nhiệm vụ cụ thể cho các cơ quan liên quan:
- Bộ Khoa học, Công nghệ và Môi trường (nay là Bộ Khoa học và Công nghệ) chịu trách nhiệm chủ trì, phối hợp với các Bộ, ngành liên quan xây dựng các tiêu chí đánh giá cụ thể và hướng dẫn các đơn vị thực hiện việc rà soát, phân loại.
- Các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ và Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương tiến hành rà soát toàn bộ hệ thống tổ chức KH&CN trực thuộc, xây dựng đề án sắp xếp lại và trình Thủ tướng Chính phủ phê duyệt.
- Bộ Tài chính và Bộ Kế hoạch và Đầu tư phối hợp cân đối, bố trí nguồn lực tài chính phù hợp để hỗ trợ quá trình sắp xếp, chuyển đổi mô hình hoạt động của các tổ chức này.
Tóm lại, Quyết định số 782-TTg là bước đi mang tính đột phá nhằm lành mạnh hóa và nâng cao hiệu suất của hệ thống khoa học công nghệ Việt Nam trong giai đoạn đầu của thời kỳ công nghiệp hóa, hiện đại hóa đất nước.

ON THE ORGANIZATION OF RESEARCH & DEVELOPMENT AGENCIES IN SCIENCE AND TECHNOLOGY
THE PRIME MINISTER
Proceeding from the Law on Organization of the Government of September 30, 1992;
Proceeding from Decision No 324-CT of September 11, 1992, of the Chairman of the Council of Ministers (now the Prime Minister) on re-organizing the system of research & development agencies in technology;
At the proposals of the Minister of Science, Technology and Environment and the Minister-Chairman of the Government Commission on Organization and Personnel,
DECIDES:
Article 1.- To re-organize the existing research & development agencies in science and technology (hereafter referred to as Institutes) of the State as follows:
1. There shall be 41 Institutes directly under the Ministries, ministerial-level Agencies and Agencies attached to the Government.
2. There shall be 6 Institutes directly under State-owned Corporations.

3. The remaining Institutes which are not yet included in the list shall be up for further consideration for organization in the following forms:
- Institutes directly under Ministries, ministerial-level Agencies, Agencies attached to the Government or State-owned Corporations;
- Institutes operating on a self-accounting basis;
- Institutes converted into independent enterprises or part of enterprises;
- Institutes merged with others or dissolved.
- With regard to the Institutes directly under Ministries, ministerial-level Agencies and Agencies attached to the Government as stipulated in Clause 1, Article 1, of this Decision, the State shall, depending on their functions, tasks and development needs, continue to supply them with operating expenses and intensive investment for development.
- With regard to the Institutes directly under State-owned Corporations as stipulated in Clause 2, Article 1, of this Decision, the owning Ministries and Corporations shall have the responsibility to manage them and assign them with tasks which are related to the operation of the Corporations. The State shall continue to support them in salary and operating expenses for a period not exceeding 5 years.
- With regard to the Institutes which draw their budget from the State but which do not belong to the said list, the State shall continue to support them in salary for a period not exceeding 5 years.

Article 3.- The Prime Minister shall assign the related branches with the following tasks:
1. The Ministry of Science, Technology and Environment shall coordinate with the Government Commission on Organization and Personnel to issue a circular providing guidance regarding the operating mechanism and the relations among the Scientific and Technological Institutes directly under State-owned Corporations.
2. The Government Commission on Organization and Personnel shall take the initiative to coordinate with the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Science, Technology and Environment and the Ministry of Finance to draft labor policies for the scientific and technological agencies and create conditions for them to rejuvenate and renew their personnel in line with their specific operating conditions in science and technology.
3. The Ministry of Planning and Investment shall take the initiative to coordinate with the Ministry of Science, Technology and Environment and the Ministry of Finance in drafting policies for promoting investment in the material bases of the scientific and technological agencies so as to help them perform the priority tasks of the State; and the policies of making deductions of capital from infrastructural construction and economic projects to carry out the scientific-technological tasks of the projects.
4. The Ministry of Finance shall take the initiative to coordinate with the State Bank of Vietnam, the Ministry of Science, Technology and Environment and the Ministry of Planning and Investment to draft policies concerning taxes and capital lending to scientific and technological organizations, and the policies of encouraging enterprises to invest in science and technology.
5. The Ministry of Science, Technology and Environment shall take the initiative to coordinate with the Government Commission on Organization and Personnel and the Ministry of Finance to draft policies and design support measures for the transition of the scientific and technological agencies which draw their salary from the State Budget to other forms of operation.
The above-said policies and measures have to be drafted and issued within December 1996.
Article 4.- This Decision takes effect from January 1st, 1997.
The Minister of Science, Technology and Environment shall take the initiative to coordinate with the Minister-Chairman of the Government Commission on Organization and Personnel to provide guidance for and inspect the implementation of this Decision and periodically report to the Prime Minister.
