Tóm tắt Quyết định số 117/2008/QĐ-BTC về sửa đổi thuế suất thuế nhập khẩu ưu đãi nhóm mặt hàng 2710
Quyết định số 117/2008/QĐ-BTC được Bộ Tài chính ban hành ngày 10 tháng 12 năm 2008 nhằm mục đích điều chỉnh mức thuế suất thuế nhập khẩu ưu đãi đối với các mặt hàng xăng, dầu và các chế phẩm từ dầu mỏ thuộc nhóm 2710. Đây là một biện pháp tài chính quan trọng nhằm bình ổn thị trường năng lượng trong nước trước những biến động mạnh mẽ của giá dầu thế giới vào giai đoạn cuối năm 2008.
Các nội dung điều chỉnh cốt lõi của Quyết định:
- Điều chỉnh thuế suất thuế nhập khẩu ưu đãi: Quyết định thực hiện việc sửa đổi, bổ sung mức thuế suất thuế nhập khẩu ưu đãi đối với một số mặt hàng thuộc nhóm 2710 quy định tại Biểu thuế nhập khẩu ưu đãi hiện hành.
- Phạm vi áp dụng đối với nhóm mặt hàng 2710: Nhóm hàng hóa 2710 bao gồm xăng động cơ (có chì và không chì), dung môi, dầu hỏa, dầu diesel, dầu nhiên liệu (FO), dầu bôi trơn và các chế phẩm khác có chứa hàm lượng dầu mỏ từ 70% trở lên theo trọng lượng.
- Mục tiêu điều tiết kinh tế vĩ mô: Việc thay đổi thuế suất đối với từng mặt hàng cụ thể trong nhóm này được tính toán dựa trên xu hướng giá dầu thô thế giới, nhằm bảo đảm hài hòa lợi ích giữa ngân sách nhà nước, doanh nghiệp đầu mối nhập khẩu xăng dầu và người tiêu dùng trong nước.
- Hiệu lực thi hành và áp dụng: Quyết định quy định rõ thời điểm có hiệu lực thi hành, áp dụng cho các tờ khai hải quan hàng hóa nhập khẩu đăng ký với cơ quan hải quan từ ngày quy định bắt đầu áp dụng.
Ý nghĩa và tác động của văn bản:
Quyết định số 117/2008/QĐ-BTC thể hiện sự linh hoạt trong chính sách thuế của Bộ Tài chính. Bằng cách điều chỉnh kịp thời thuế suất nhập khẩu nhóm mặt hàng 2710, Nhà nước có thể chủ động kiểm soát giá xăng dầu nội địa, hạn chế tác động tiêu cực của lạm phát và hỗ trợ hoạt động sản xuất, kinh doanh của các doanh nghiệp trong nước.

DECISION
AMENDING PREFERENTIAL IMPORT DUTY RATES APPLICABLE TO GROUP 2710 GOODS ON THE PREFERENTIAL IMPORT TARIFF LIST
THE MINISTER OF FINANCE
Pursuant to the Law on Export and Import Duties dated 14 June 2005;
Pursuant to Resolution 295/2007/NQ-UBTVQH12 of the National Assembly Standing Committee dated 28 September 2007 promulgating both the Import and Export Tariff List and the Preferential Import and Export Tariff List for groups of taxable goods and the tax rate frames applicable to each group in each List;
Pursuant to Decree 149/2005/ND-CP of the Government dated 15 December 2005 on implementation of the Law on Export and Import Duties;
Pursuant to Decree 77/2003/ND-CP of the Government dated 1 July 2003 on functions, duties, powers and organizational structure of the Ministry of Finance;
Having considered the proposal of the Director of the Tax Policy Department;
DECIDES:
Article 1
To issue in the List attached, the new preferential import duty rates applicable to Group 2710 goods on the Preferential Import Tariff List as stipulated in Decision 106-2007-QD-BTC of the Minister of Finance dated 20 December 2007 (as amended).
Article 2
This Decision shall apply to import goods' customs declarations registered with the customs office as from 11 December 2008, and shall be of full force and effect fifteen (15) days after the date on which it is published in the Official Gazette.
