Tóm tắt Quyết định số 47/2000/QĐ-BTC bãi bỏ các khoản phí, lệ phí cấp giấy phép trái với Luật Doanh nghiệp
Quyết định số 47/2000/QĐ-BTC được Bộ Tài chính ban hành ngày 4 tháng 4 năm 2000 nhằm mục đích bãi bỏ các khoản phí, lệ phí liên quan đến việc cấp các loại giấy phép, giấy chứng nhận không phù hợp với quy định của Luật Doanh nghiệp năm 1999. Đây là một bước đi quan trọng trong tiến trình cải cách thủ tục hành chính, xóa bỏ các "giấy phép con" gây cản trở cho hoạt động sản xuất kinh doanh của doanh nghiệp.
- Nội dung cốt lõi của Quyết định (Từ Điều 1 đến Điều 4):
- Bãi bỏ các khoản phí và lệ phí trái luật (Điều 1): Quyết định quy định rõ việc bãi bỏ toàn bộ các khoản phí, lệ phí cấp giấy phép, giấy chứng nhận hoặc các hình thức văn bản chấp thuận khác do các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ hoặc Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương ban hành trái với tinh thần và quy định của Luật Doanh nghiệp. Việc này giúp giảm bớt gánh nặng tài chính và thủ tục phiền hà cho các nhà đầu tư khi gia nhập thị trường.
- Xử lý các khoản thu sai quy định (Điều 2): Các cơ quan, tổ chức trước đây thực hiện thu các khoản phí, lệ phí thuộc danh mục bị bãi bỏ phải chấm dứt ngay hoạt động thu này. Mọi hành vi tiếp tục thu phí, lệ phí cấp giấy phép trái quy định sẽ bị coi là vi phạm pháp luật về tài chính và bị xử lý nghiêm theo quy định của pháp luật hiện hành.
- Trách nhiệm tổ chức thực hiện (Điều 3): Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương và các đơn vị trực thuộc Bộ Tài chính có trách nhiệm chỉ đạo, kiểm tra và đôn đốc việc thực hiện nghiêm túc Quyết định này. Tổng cục Thuế và các Cục Thuế địa phương có nhiệm vụ giám sát chặt chẽ việc dừng thu các khoản phí, lệ phí đã bị bãi bỏ.
- Hiệu lực thi hành (Điều 4): Quyết định này có hiệu lực thi hành sau 15 ngày kể từ ngày ký ban hành. Các quy định trước đây của Bộ Tài chính hoặc các cơ quan khác trái với Quyết định này đều bị bãi bỏ.
- Ý nghĩa và tác động của văn bản:
Quyết định số 47/2000/QĐ-BTC đóng vai trò thiết thực trong việc cụ thể hóa chủ trương của Chính phủ về việc tạo lập môi trường kinh doanh thông thoáng, bình đẳng và minh bạch. Bằng việc kiên quyết bãi bỏ các khoản phí, lệ phí không hợp pháp, văn bản đã góp phần thúc đẩy tinh thần khởi nghiệp, bảo vệ quyền lợi hợp pháp của doanh nghiệp và hạn chế tình trạng nhũng nhiễu, tiêu cực trong bộ máy quản lý nhà nước thời kỳ đầu mở cửa kinh tế.

DECISION
CANCELING THE FEES FOR THE GRANTING OF LICENSES AND PERMITS WHICH ARE CONTRARY TO THE LAW ON ENTERPRISES
THE MINISTER OF FINANCE
Pursuant to the Governments Decree No. 15/CP of March 2, 1993 on the tasks, powers and management responsibilities of the ministries and ministerial-level agencies;
Pursuant to the Governments Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to the Governments Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget;
Pursuant to the Prime Ministers Decision No. 19/2000/QD-TTg of February 3, 2000 on canceling licenses and permits which are contrary to the Law on Enterprises;
At the proposal of the General Director of Tax,
DECIDES:
Article 1.- To cancel the collection of fees for the granting of the following licenses and permits:
1. Fee for the granting of certification of environmental pollution control
2. Fee for the granting of certificate of qualifications for trading in discarded metal materials and scraps

5. Fee for the granting of permit for movement of exploitation forces
6. Fee for the granting of permit for offshore fishing

Article 2.- This Decision takes effect as from February 3, 2000. To annul the regulations on charges and fees, which are contrary to this Decision.
1. The ministries, the ministerial-level agencies, the agencies attached to the Government, the People’s Committees at all levels and the concerned agencies shall base themselves on the List of charges and fees, issued together with the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget and the Prime Minister’s Decision No. 19/2000/QD-TTg of February 3, 2000 canceling licenses and permits which are contrary to the Law on Enterprises, to promptly cancel charges and fees, which have been respectively set by themselves and are currently collected in contravention of regulations.
